Vendor placement terms

These terms apply to vendor placements purchased through realtyops.ai/vendors. You accept them when you add a payment method.

1. What a placement is

A placement is advertising, sold per brokerage. For $150.00 per month, B.A.M.S. for Real Estate LLC d/b/a RealtyOps ("RealtyOps") displays the card you create (company name, logo, category, tagline, description, offer, contact details and files) in the Sponsored areas of the RealtyOps product shown to one real estate brokerage and its agents. Each additional brokerage is another $150.00 per month; for example, five brokerages are $750.00 per month. RealtyOps chooses the brokerages and places your card within two business days of payment, and your portal shows where it appears. Placement is not exclusive, not limited to any territory, and does not guarantee any number of views, clicks, calls or business.

2. No referral fees

No part of your payment is paid, credited or otherwise passed to any brokerage, broker, agent or other settlement service provider, and no brokerage or agent pays you for placement. Placement is not conditioned on the referral of settlement service business and must not be described as such. Any offer you print on your card is extended by you to the brokerage and its agents and must comply with applicable law, including RESPA and Florida law, on its own terms.

3. Your content

You are responsible for everything on your card. It must be accurate, lawful, and must not infringe anyone else's rights. You grant RealtyOps a non-exclusive license to display it within the product and in previews of the product. RealtyOps may remove or edit content that is misleading, off-category, offensive, reported by a brokerage, or otherwise unsuitable, and may pause a placement while it reviews a complaint.

4. Brokerage control

Each brokerage decides what its agents see. A brokerage administrator may hide your card from that brokerage at any time. When that happens RealtyOps will place the paid brokerage slot in another brokerage where one is available; it does not refund or credit for hidden cards.

5. Billing, minimum term and cancellation

Placements bill monthly in advance through Stripe at $150.00 per brokerage. You may add brokerages at any time, prorated to your billing date; each brokerage slot has the same minimum term as the placement, so brokerages can be removed only after the minimum term. Each placement has a minimum term of 3 months from the date it first goes live, during which it cannot be canceled; the monthly fee remains payable for the full minimum term even if you stop using the portal or ask for the card to be taken down early. After the minimum term the placement continues month to month and you may cancel at any time from your portal; the card remains displayed until the end of the month already paid. Fees are non-refundable, including for partial months, paused placements, and cards hidden by brokerages. If a payment fails, RealtyOps may continue to display the card while the charge is retried and may remove it if the charge does not clear; a placement removed for non-payment still owes the balance of its minimum term.

6. Data you receive

Your portal shows aggregate views and clicks and the names of brokerages whose users clicked your card. You will not receive the identity of individual agents or users. You agree to use this information only to evaluate your placement.

7. Changes and termination

RealtyOps may change the price, the placement surfaces, or these terms on 30 days' notice by email to your account address; continuing to pay after that date is acceptance. Either party may end the placement at any time. RealtyOps may end it immediately for a breach of these terms.

8. Disclaimer and liability

RealtyOps provides placements as is, without warranty of results. To the fullest extent permitted by law, RealtyOps' total liability arising from a placement is limited to the fees you paid for the three months before the claim. These terms are governed by Florida law. The RealtyOps Terms of Service apply to your use of the portal where not inconsistent with these terms.
